Yerevan /Mediamax/. Armenia’s Representative in the European Court on Human Rights (ECHR) stated today that the Court's decision to satisfy Armenia’s application against Azerbaijan and apply interim measures can be considered as a great success.
“In the decision, the Court calls upon both Azerbaijan and Armenia to refrain from taking measures, which might entail breaches of the Convention rights of the civilian population. However, it should be taken into consideration that the decision was made at the request of the Republic of Armenia and on the basis on evidence. Although the two states are mentioned in the decision, I think the burden falls more on the government of Azerbaijan. It is also important that the court did not consider it necessary to send it to the Azerbaijani government to get additional information or comment, which is usually done,” Yeghishe Kirakosyan said.
He also noted that this is a unique case when the ECHR applies interim measure based on the application of a country.
“This is the third case; the first two referred to Ukraine’s applications. In all cases, the court referred to both parties. From this point of view, we can say that this is a great success for us,” said Yeghishe Kirakosyan.
The ECHR has also asked both parties to inform the ECHR, as soon as possible, of measures taken to comply with their conventional obligations.
“In the coming days, Armenia will present the measures taken that have been taken, which, I am sure, will be more than enough. We will also wait for the response of the Azerbaijani government and will voice our position based on that,” he said.
Kirakosyan also noted that Armenia submitted the application on the evening of September 27, and in the following days continued to provide additional evidence, briefing on the situation, emphasizing specific cases, targeting of the civilian population.
